1. General Provisions

These Terms of Use (hereinafter referred to as the “Terms”) define the conditions for access to the functionality of the Flammoro mobile application (hereinafter referred to as the “Application”), as well as the rules governing the use of its services, content, and features.

The Flammoro Application is provided and operated by an individual — Maksim Pianykh, acting as the operator of the Application (hereinafter referred to as “Flammoro”, “we”, “us”, or “our”).

By using the Application, you confirm that:

• You have read and agree to these Terms;

• You agree to the provisions of our Privacy Policy;

• You are at least 18 years old;

• You will not create an account or use the Application if you are under 18 years of age;

• You understand that Flammoro may request age verification and restrict access to the Application until such verification is completed;

• You acknowledge that failure to comply with these Terms may result in restriction, suspension, or termination of access to the Application.

Flammoro reserves the right to amend these Terms in the event of changes in applicable law, Application functionality, security requirements, or other justified circumstances.

Users will be notified of material changes to the Terms through in-app notifications, email, or other reasonable means prior to such changes taking effect, unless otherwise required by law or necessary to immediately address security risks or comply with legal obligations.

Unless otherwise specified, the updated version of the Terms shall take effect from the date indicated in the relevant version.

2. Registration and Account

To use the functionality of the Flammoro Application, the user must complete the registration process and create a personal account. By registering, you confirm that the information you provide is accurate, complete, and up to date.

You agree to keep your information accurate and updated throughout your use of the Application.

Age Verification

To ensure user safety and compliance with applicable laws, Flammoro uses an age verification system.

During registration or while using the Application, you may be required to:

• Verify your age using a selfie and/or age assurance technologies (age estimation or verification);

• If a selfie is insufficient — provide an identity document (such as a passport or ID card).

The processing of data required for age verification may be carried out using automated technologies and third-party services, solely for the purpose of verifying age, preventing access by minors, and ensuring platform safety.

Flammoro reserves the right to:

• Restrict access to the Application until age verification is completed;

• Refuse registration or block an account if age cannot be verified;

• Delete an account in case of false or misleading age information.

Strictly Prohibited

You are strictly prohibited from:

• Creating accounts on behalf of other individuals or legal entities without proper authorization;

• Providing false, fictitious, or misleading information (including name, age, gender, photos, or location);

• Using another person’s email address, phone number, or credentials;

• Creating multiple accounts for personal use (except in cases explicitly allowed for testing with administrative approval);

• Using the Application if you are under 18 years of age;

• Providing false information for age verification or attempting to bypass verification mechanisms.

User Responsibility

You are fully responsible for the security of your account credentials (login, password, access via Apple, Google, phone number, or other authentication providers) and agree to immediately notify Flammoro of any suspected unauthorized use of your account.

You also agree to:

• Provide accurate information, including data required for age verification;

• Not attempt to bypass age verification, moderation, or other security mechanisms of the Application.

Flammoro reserves the right to temporarily restrict or permanently block access to your account in case of violations of these Terms, suspicious activity, or upon request from competent authorities.

By registering, you confirm that you fully understand and accept these Terms.

3. Use of the Application

The Flammoro Application provides users with access to the following features:

• Searching and filtering other users’ profiles based on selected parameters (including geolocation, interests, age, and dating goals);

• Exchange of text messages, images, videos, and voice messages;

• Audio and video calls;

• Uploading, displaying, rating, and commenting on user media (photos and videos);

• Use of geolocation services to display nearby users and enable interaction;

• Use of recommendation systems to match and display other users’ profiles.

Recommendation Systems

Flammoro uses recommendation algorithms to display user profiles. These recommendations may be based on:

• Geolocation and distance;

• Declared interests and preferences;

• Age and dating goals;

• User activity within the Application;

• Search filters and user-defined settings.

Users can influence recommendations by adjusting their settings, filters, and search parameters within the Application.

Conditions of Use

You agree to use the Application only for lawful, good-faith, and respectful purposes and to refrain from any actions that violate the rights of other users or applicable law.

Prohibited Activities

You are prohibited from:

• Uploading, publishing, or distributing unlawful, discriminatory, offensive, defamatory, threatening, or misleading content;

• Posting sexually explicit content, pornography, or any content involving the sexual exploitation or abuse of minors (CSAE), which will result in immediate account suspension and reporting to competent authorities;

• Harassing, threatening, stalking, blackmailing, or otherwise abusing other users;

• Impersonating another person or using someone else’s photos, data, or identity;

• Using generated or altered images/videos (including deepfakes) that mislead others regarding your identity;

• Violating intellectual property rights, privacy rights, or image rights of third parties;

• Distributing spam, advertisements, fraudulent offers, or engaging in phishing activities;

• Using automated tools (bots, scripts, scrapers) to interact with the Application or collect data;

• Attempting to bypass security systems, moderation mechanisms, access restrictions, or age verification systems;

• Using the Application for illegal purposes or in violation of the rules of distribution platforms (including Apple App Store and Google Play).

Moderation and Safety

To ensure user safety, Flammoro applies automated and manual moderation mechanisms, including:

• Reviewing content (photos, videos, messages) for compliance with these Terms;

• Detecting prohibited or potentially harmful content;

• Processing user reports regarding content or behavior.

Flammoro reserves the right to:

• Remove or restrict access to content without prior notice;

• Limit account functionality;

• Temporarily or permanently suspend users in case of violations;

• Report information to law enforcement authorities where required by law.

Technical and Legal Limitations

Access to certain features (including video calls, media sharing, advanced filters, and other functionalities) may depend on:

• The user’s age;

• The results of age verification;

• Subscription status (e.g., Premium);

• Device capabilities and internet connection;

• Geographic and legal restrictions.

Flammoro reserves the right to modify, restrict, or suspend access to certain features at any time for security, legal compliance, or technical reasons.

User Responsibility

By using the Application, you confirm that:

• You are personally responsible for all actions performed through your account;

• You comply with these Terms and applicable law;

• You understand the risks of interacting with other users and do so at your own risk.

4. User Content

You are solely responsible for all content that you create, upload, publish, transmit, or otherwise make available through the Flammoro Application. This includes, but is not limited to, photos, videos, audio recordings, profile descriptions, messages, and comments.

By posting content in the Application, you confirm that:

• You have all necessary rights (including intellectual property and ownership rights) to use and publish such content;

• You do not violate the rights of third parties, including privacy rights, image rights, honor, dignity, and personal data protection;

• You have obtained consent from all individuals depicted in photos or videos for their publication in the Application.

Content License

By posting content in the Flammoro Application, you grant the operator of the Application — Maksim Pianykh (hereinafter referred to as “Flammoro”) a non-exclusive, royalty-free, worldwide, purpose-limited, and revocable license to use, store, reproduce, display, and otherwise process such content solely to the extent necessary for:

• Operation of the Application;

• Displaying content to other users within the functionality of the service;

• Ensuring safety and moderation;

• Technical processing, storage, and transmission of data;

• Improvement and development of the Application.

This license remains valid for the duration of the content’s availability in the Application and terminates upon its deletion by the user, except where continued storage is required:

• To comply with legal obligations;

• To prevent abuse or resolve disputes;

• In other cases provided by applicable law.

Flammoro does not acquire ownership rights to user content.

Prohibited Content

You are prohibited from publishing or distributing:

• Content that infringes intellectual property rights of third parties (copyright, trademarks, etc.);

• Sexually explicit content, pornography, or any content involving the sexual exploitation or abuse of minors (CSAE);

• Any images, videos, or materials involving minors in a manner that violates applicable laws or safety standards;

• Content depicting violence, cruelty, blood, injury, or other disturbing material;

• Content containing hate speech, discrimination, insults, or threats;

• Bullying, harassment, stalking, blackmail, or other forms of abuse;

• False, misleading, or defamatory information;

• Personal data of others without their consent;

• Content related to fraud, spam, or illegal activities;

• Use of another person’s images, data, or identity (impersonation);

• Use of generated or altered content (including AI/deepfake) that misleads others about identity;

• Any content that violates applicable laws of the European Union, Austria, or other jurisdictions.

Content Moderation

Flammoro applies automated and, where necessary, manual moderation mechanisms to ensure user safety and compliance with applicable laws.

Content review may include:

• Analysis of images and videos for prohibited content;

• Detection of faces and compliance with age-related requirements;

• Identification of violence, sexual content, or unlawful activity;

• Use of automated technologies and third-party services for content analysis.

⚠️ Flammoro does not guarantee pre-moderation of all user content before publication.

Enforcement Measures

Flammoro reserves the right to:

• Reject, remove, or restrict access to any content without prior notice;

• Limit account functionality;

• Temporarily or permanently suspend accounts in case of violations;

• Report information to law enforcement authorities where required by law.

Content Complaints

Users may report content or behavior that violates these Terms through the in-app reporting mechanisms.

Complaints are reviewed within a reasonable timeframe. Where necessary, appropriate measures may be taken, including content removal or restriction of account access.

5. Subscriptions and Payments

The Flammoro Application provides basic access to core features free of charge. Certain advanced features are available through a paid Premium subscription.

Premium Subscription

The Premium subscription may include:

• Advanced search filters;

• Unlimited messaging;

• Access to audio and video calls;

• Priority profile visibility and other additional features.

The scope of Premium features may change and depends on the selected plan.

Subscription Terms

• Subscriptions are purchased via in-app purchases using your Apple App Store, Google Play, or other official platform account;

• Payment is charged to your selected payment method upon confirmation of purchase;

• Subscriptions automatically renew for the next billing period unless auto-renewal is disabled at least 24 hours before the end of the current period;

• Subscription pricing may vary depending on region, selected plan, and currency;

• Access to Premium features is granted for the paid subscription period upon successful payment.

If a free trial is offered, its terms will be specified within the Application interface.

Subscription Management

• You may manage your subscription and disable auto-renewal through your account settings in the Apple App Store, Google Play, or other applicable platform;

• Cancellation takes effect at the end of the current billing period;

• Deleting the Application does not automatically cancel your subscription.

Payments and Data Processing

• All payments are processed by the respective platforms (e.g., Apple App Store or Google Play) in accordance with their terms and privacy policies;

• Flammoro does not collect or store credit card or other payment details;

• For any questions regarding payments, charges, or refunds, users must contact the relevant platform’s support service.

Refunds and Consumer Rights

Refunds and payment cancellations are governed by the rules of the respective platform (Apple App Store, Google Play) and applicable law.

Nothing in these Terms limits your rights as a consumer under applicable law (including the laws of the European Union and Austria).

Legal Compliance

Payment operations are carried out in accordance with applicable laws, including:

• European Union consumer protection laws;

• Austrian legislation;

• Policies and rules of app distribution platforms (Apple App Store, Google Play, etc.).

6. Restrictions on Use

To ensure a safe, fair, and lawful environment within the Flammoro Application, users are prohibited from:

• Using the Application to distribute spam, phishing, fraudulent schemes, or other forms of deception;

• Harassing, threatening, stalking, blackmailing, bullying, or otherwise abusing other users;

• Using malicious software, including viruses, trojans, or any code intended to disrupt the operation of the Application, user devices, or service infrastructure;

• Using automated tools (bots, scripts, crawlers, or similar technologies) to collect data or interact with the Application;

• Collecting, storing, or sharing personal data of other users without their explicit consent, in violation of applicable data protection laws;

• Impersonating another person or using another individual’s images, data, or identity (including the use of altered or generated content such as deepfakes);

• Misusing Application features, including geolocation, recommendation systems, messaging, calls, or other interaction mechanisms;

• Attempting to gain unauthorized access to other users’ accounts, internal data, or Flammoro infrastructure;

• Attempting to bypass security measures, moderation systems, access restrictions, or age verification mechanisms;

• Using the Application in violation of applicable law or in jurisdictions where its use is prohibited.

Enforcement Measures

In case of violations of these Terms, Flammoro may apply measures proportionate to the nature and severity of the violation, including:

• Removal or restriction of access to content;

• Limitation of account functionality;

• Temporary suspension of access;

• Permanent account suspension or termination.

Where there are indications of unlawful activity, Flammoro may report relevant information to competent authorities in accordance with applicable law.

Subscription Impact and Consequences of Violations

In the event of account restriction or suspension due to violations of these Terms:

• Access to Application features, including Premium, may be limited or terminated;

• Refunds are handled in accordance with the rules of the respective platforms (Apple App Store, Google Play) and applicable law.

Right to Take Action

Flammoro reserves the right to remove content, restrict access to features, or take other appropriate measures in response to abuse, violations, or risks to user safety or platform integrity.

7. Geolocation

The Flammoro Application uses location technologies to provide core features of the service, including:

• Displaying nearby users;

• Filtering profiles by distance;

• Generating recommendations based on geographic proximity;

• Enabling interaction between users.

Consent to the Processing of Location Data

Geolocation data is processed only with your prior, explicit, and freely given consent, in accordance with applicable laws, including:

• The General Data Protection Regulation (GDPR);

• The Austrian Data Protection Act (DSG);

• Other applicable data protection laws.

Managing Geolocation

You may at any time:

• Disable access to location services in your device settings;

• Limit location sharing (for example, to approximate location, if supported by your device);

• Withdraw your consent to the processing of location data;

• Submit a request for the deletion of previously collected data.

⚠️ Disabling geolocation may result in limited or unavailable functionality within the Application.

Principles of Location Data Processing

Flammoro applies the following principles when processing location data:

• Data is used only to the extent necessary for the operation of Application features (data minimization principle);

• User location is not publicly displayed with exact address precision, but rather as an approximate location or distance;

• Data is transmitted and stored using appropriate technical and organizational security measures, including cloud infrastructure (e.g., Google Cloud / Firebase);

• Geolocation data is not used for third-party advertising or shared with third parties without a legal basis or user consent.

Limitations and Specifics

Flammoro processes location data only within the scope of the Application’s functionality and in accordance with user settings and device permissions.

In certain cases (for example, when actively using location-based features), location data may be processed in the background, provided that such processing is permitted by the user at the operating system level.

8. Safety and User Responsibility

Flammoro places a high priority on user safety and takes reasonable technical and organizational measures to protect the digital environment and interactions within the Application.

The following mechanisms are implemented to ensure safety:

Content Moderation

Flammoro uses automated and, where necessary, manual content review mechanisms aimed at detecting violations of these Terms.

Such review may include:

• Analysis of photos and videos for prohibited content (including violence, sexual content, and legal violations);

• Detection of materials involving minors;

• Identification of abuse, fraud, or misleading behavior;

• Use of automated technologies, including third-party services (e.g., AWS).

⚠️ Flammoro does not guarantee pre-moderation of all user content before publication.

Reporting System

Users may report violations through in-app reporting mechanisms (for profiles, messages, media, or behavior).

Reports are reviewed within a reasonable timeframe, after which appropriate measures may be taken in accordance with these Terms.

Enforcement Measures

In the event of violations, Flammoro may take measures proportionate to the nature of the violation, including:

• Restricting access to content or features;

• Temporary suspension of the account;

• Permanent account suspension or termination.

Consequences for subscriptions and payments are governed by a separate section of these Terms and applicable law.

Technical Security

Flammoro applies reasonable measures to protect data and infrastructure, including:

• Transmission of data via secure communication channels (e.g., HTTPS);

• Use of cloud infrastructure (e.g., Firebase / Google Cloud) with access control mechanisms;

• Implementation of safeguards against unauthorized access (e.g., App Check and similar technologies);

• Use of technical measures to restrict direct access to user content.

User Responsibility

The user is fully responsible for:

• The accuracy of the information provided;

• Compliance with the laws of their jurisdiction (including age restrictions);

• Their behavior within the Application and interactions with other users.

Limitation of Platform Responsibility

Flammoro does not control user actions outside the Application and is not responsible for:

• User behavior outside the platform, including in-person meetings;

• Any damage resulting from interactions between users, including fraud, deception, or abuse.

Safety Recommendations

Users agree to:

• Exercise reasonable caution when interacting with other users;

• Arrange in-person meetings in public places;

• Avoid sharing sensitive information (such as home address or financial details) with strangers.

In case of safety threats or unlawful activity, users should immediately contact law enforcement authorities and notify Flammoro support.

9. Intellectual Property

All intellectual property objects available within the Flammoro mobile application, including but not limited to:

• User interface design and UX structure;

• Textual content (descriptions, prompts, terms);

• Graphic elements, icons, and illustrations;

• Database structure and content;

• Source code, architecture, and software logic;

• Name, branding, logos, and trademarks,

are the property of the Application operator — Maksim Pianykh, unless otherwise explicitly stated, or are used on a lawful basis, and are protected under applicable intellectual property laws.

Restrictions on Use

Without prior written consent from the Flammoro operator, it is prohibited to:

• Copy, reproduce, or extract any elements of the Application;

• Modify, translate, or use the interface or functionality in other products;

• Use logos, branding, or other brand elements;

• Distribute, sell, or license any part of the Application;

• Publish or place elements of the Application or its content on third-party platforms.

User Rights

Flammoro grants the user a limited, revocable, non-exclusive, and non-transferable license to use the Application solely for personal and non-commercial purposes.

User Content

Users retain rights to the content they create and publish within the Application, subject to compliance with these Terms.

At the same time, users grant Flammoro the rights to use such content to the extent necessary for the operation of the Application, in accordance with the User Content section.

Violations

In the event of a violation of intellectual property rights, Flammoro reserves the right to:

• Require cessation of the infringement;

• Restrict or suspend the user’s account;

• Remove the relevant content;

• Take other measures provided by applicable law.

10. Termination of Use

10.1 Voluntary Account Deletion

You may stop using the Flammoro Application at any time.

Account deletion may be performed:

• Through the profile settings within the Application;

• By submitting a request to customer support (including via web form or email, where available).

After confirmation of account deletion:

• The user’s personal data (including name, photos, videos, messages, and other profile data) will be deleted or anonymized within a reasonable timeframe, generally within one month after confirmation of the request, unless retention is required by applicable law;

• Certain data may be retained in a limited scope for the purpose of complying with legal obligations (e.g., accounting, fraud prevention, or compliance with legal requirements);

• You will lose access to your account and all associated features, including Premium functionality;

• Subscriptions purchased via the Apple App Store, Google Play, or other platforms must be canceled separately by the user through the respective platform.

⚠️ Deleting the Application from your device does not automatically delete your account.

10.2 Forced Account Deletion and Suspension

The operator of the Flammoro Application — Maksim Pianykh (hereinafter referred to as “Flammoro”) reserves the right to take measures with respect to a user account, including restricting functionality, temporary suspension, or permanent deletion of the account, in the following cases:

• Violation of these Terms of Use or the Privacy Policy;

• Violation of the rights of third parties (including intellectual property, property, personal, and other rights);

• Posting prohibited content (including, but not limited to, sexual content, violence, threats, discrimination, fraud, or spam);

• Use of automated tools (bots, scripts, or similar technologies) to interact with the Application;

• Attempts to bypass restrictions, security systems, age verification, or paid features;

• Indications of unlawful activity;

• Other actions that pose a threat to user safety, the operation of the Application, or compliance with applicable law.

Enforcement Measures

Measures are applied proportionally to the nature and severity of the violation and may include:

• Restriction of specific Application features;

• Temporary suspension of account access;

• Permanent suspension or deletion of the account.

Flammoro may apply such measures without prior notice if necessary to:

• Ensure user safety;

• Comply with applicable law;

• Prevent abuse or fraud;

• Prevent harm to the Application or third parties.

In other cases, where feasible, the user may be notified of the measures taken.

Appeal Process

Users have the right to submit a request to Flammoro for review of decisions related to restricted functionality, temporary suspension, blocking, or deletion of an account.

Such requests are reviewed within a reasonable timeframe, taking into account the nature of the violation, applicable law, and the need to ensure the safety of users and the platform.

Submitting a request does not guarantee reversal of the decision; however, Flammoro will review such requests in good faith and with due diligence.

Subscriptions and Payments

In the event of account restriction or suspension due to violations of these Terms:

• Access to Application features, including Premium, may be limited or terminated;

• Refunds, subscription cancellations, and other payment-related matters are governed by the rules of the respective platforms (e.g., Apple App Store or Google Play), as well as mandatory provisions of applicable consumer protection laws.

10.3 Data Retention

After account deletion, the processing and storage of data are carried out in accordance with applicable law.

In particular:

• Personal data is deleted or anonymized within a reasonable timeframe, unless there are lawful grounds for further retention;

• Certain data may be retained in a limited scope and for a defined period to comply with legal obligations (e.g., accounting, legal compliance, fraud prevention, and security purposes);

• Data processing and storage are based on applicable legal grounds, including compliance with legal obligations, protection of legitimate interests, and adherence to regulatory requirements;

• Access to retained data is restricted and protected through appropriate technical and organizational security measures.

Transfer of data to third parties is permitted only where there is a valid legal basis, including:

• Compliance with legal requirements or requests from competent authorities;

• The necessity to ensure the operation of the Application (e.g., through trusted service providers);

• Other cases provided for in the Privacy Policy and applicable law.

11. Disclaimer of Warranties

11.1 General Disclaimer

The Flammoro Application is provided to the user on an “as is” and “as available” basis, to the maximum extent permitted by applicable law.

Use of the Application is at the user’s own risk.

Flammoro makes no warranties, including but not limited to:

• That the Application will operate continuously, error-free, or securely;

• That all features will be available at all times or in any geographic location;

• That the Application will be compatible with a specific device, operating system, or third-party services;

• That the Application will be free from technical errors, failures, or vulnerabilities;

• The accuracy, reliability, or timeliness of information provided by other users;

• That the Application or its features will meet the user’s expectations.

Nothing in these Terms limits any rights of the user that cannot be excluded or restricted under applicable law.

11.2 Exclusion of Implied Warranties

To the maximum extent permitted by applicable law, Flammoro disclaims all implied warranties, including but not limited to:

• Warranties of merchantability;

• Warranties of fitness for a particular purpose;

• Warranties of non-infringement.

This provision applies to the extent that such warranties may be lawfully excluded or limited.

Nothing in this section limits any rights of the user that cannot be excluded or restricted under applicable law.

11.3 Third Parties and External Links

To the maximum extent permitted by applicable law, Flammoro is not responsible for the actions of third parties, including but not limited to:

• The behavior of other users of the Application, including their actions both within and outside the platform;

• Content created and published by users;

• External links or third-party resources accessible through the Application (if any);

• The operation of third-party services, technologies, or providers not under Flammoro’s control;

• Any damage to user devices, data, or accounts resulting from interaction with third parties or external services.

Flammoro is not a party to interactions between users and does not control such interactions.

Nothing in this section limits Flammoro’s liability where such liability cannot be excluded or limited under applicable law.

11.4 Special Provisions

In some jurisdictions, applicable law may not allow the exclusion or limitation of certain warranties and consumer rights.

In such cases, the provisions of this section shall apply to the maximum extent permitted and only to the extent that they do not conflict with mandatory provisions of applicable law.

If any provision of this section is found to be invalid or unenforceable in a particular jurisdiction, this shall not affect the validity of the remaining provisions.

12. Limitation of Liability

12.1 General Provisions

To the maximum extent permitted by applicable law, the operator of the Flammoro Application — Maksim Pianykh (hereinafter referred to as “Flammoro”), as well as his contractors, service providers, and other persons acting within the scope of their authority, shall not be liable for any losses or damages arising from:

• The use or inability to use the Application;

• The actions or omissions of other users;

• Content posted by users;

• Technical failures, errors, or interruptions in the operation of the Application;

• Unauthorized access, data loss, or other incidents beyond Flammoro’s control.

This limitation of liability applies to the maximum extent permitted by applicable law.

Nothing in this section excludes or limits Flammoro’s liability in cases where such liability cannot be excluded or limited under applicable law, including but not limited to:

• Intentional misconduct;

• Gross negligence;

• Other cases where limitation of liability is expressly prohibited by law.

12.2 Exclusion of Liability for Damages

To the maximum extent permitted by applicable law, Flammoro shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

• Damages related to Application malfunctions, temporary unavailability of the service, or technical failures;

• Loss of profits, revenue, business opportunities, or reputation;

• Loss of data, including personal settings, photos, videos, or message history;

• Damages arising from interactions between users, including offline meetings, content exchange, calls, and messaging.

This limitation applies to the extent permitted by applicable law.

12.3 User Responsibility

The user is responsible for their actions when using the Application, as well as for all content they publish.

The user agrees to:

• Comply with the applicable laws of their jurisdiction;

• Respect the rights and legitimate interests of other users and third parties;

• Provide accurate information and not mislead other users;

• Exercise reasonable caution when interacting with other users, including communication and potential offline meetings;

• Independently assess the risks associated with using the Application and interacting with third parties.

The user understands and agrees that they bear full responsibility for the risks associated with interactions with other users, to the maximum extent permitted by applicable law.

12.4 Statutory Limitations
